Member Responsibilities

The Member’s system begins at the outlet of the coop provided water metering device and includes all piping, fittings, appurtenances, and fixtures connected downstream of the metering device.

Maintain your plumbing system to assure your system is free from leaks thus conserving the coop’s water supply. Failure to remedy leaks in a timely manner may result in your site being disconnected from the coop distribution system.

Maintain the safety of your site’s distribution system by keeping your system in compliance with the rules, regulations and standards of the Illinois State Plumbing Code and the IEP A.

At the coop’s request accompany a coop representative on a walkthrough of your system.

Cross-connections can result in a source of contamination to the public water supply. Notify the coop of any cross-connection in your system.

Respond to the IEP A mandated Cross-Connection Survey conducted by the coop. If a survey is not returned the coop may request a walk through to review your system for possible cross-connections.

Return executed proxies authorizing the Board to vote in your behalf at the Annual Meeting if you elect not to attend.

Pay your invoice in a timely manner. By keeping your account up to date you prevent becoming a burden upon neighbors and other coop members.

Immediately report any suspicious or unusual activity in regards to your water coop system to the management office.

Be alert for coop public notices and communique and react in a responsible and appropriate manner.

Rules and Regulations

SUMMARY OF PROVISIONAL RULES AND REGULATIONS FOR OPERATION OF THE LAKE SARA AREA WATER COOPERATIVE, INC. WATER SYSTEM.

Section 1 Application for Services –

Water services shall be furnished only to Corporation Members upon filing an application and water users agreement with the Secretary of the Corporation or his designated representative upon a form to be supplied by the Corporation.

Section 2 Initial and Minimum Charges –

Whether water is used or not, the rates as shown in the Rate Schedule in Section 8 of this resolution shall be paid by each customer who has signed a User’s Contract beginning at the time the Corporation makes the service available to the customer.

Section 3 Corporation’s Responsibility and Liability

A. Ownership, Installation, and Maintenance

The Corporation shall install, own and maintain the complete water system, water mains, and service lines to the property line or a mutually agreed-upon point subject to the Board of Directors determination that a particular service is economically feasible to install. The Corporation shall furnish, install, and maintain a meter and appurtenances including a shut-off valve.

B. Refusal of Service

The Corporation may at any time refuse additional services to any applicant if in the judgment of the Board the capacity of the system will not permit such use.

C. Liability

All water service supplied by the Corporation shall be upon the express condition that the Corporation shall not be liable nor shall any claim be made against it for damages or injury caused by reason of shutting off of the water for repair, relocation, or expansion of any part of the system, or for the concentration of water for such purposes as fire fighting, or restricted use of water or failure of any part of the system.

D. Damage of Water on Member’s Premises

The Corporation shall reserve the right to use the water from the member’s facilities at any time deemed necessary. No charge shall be made by the member for the use of his facilities and no charge shall be made by the Corporation for the water used by the Corporation.

Section 4 Member’s Responsibility

A. Installing and Maintaining Service Lines

The member shall be responsible for the installation and maintenance of service lines between the meter and the residence or business. Contact the Board for specifications for service lines and installation information.

B. Provisions for Location of Meter

The member shall permit the meter to be located upon his property.

C. Easements

Contact the Board if there are any questions on easements.

D. Damage to Corporation Property

No member, agent of a member, independent contractor, or other person shall tamper, adjust, damage, or in any manner interfere with the components or operation of the water system owned by the Corporation. Contact the Board for penalties.

E. Specified Uses of Water

Water purchased from the Corporation may be used for ordinary domestic, industrial or farm use upon the premises of the member provided: 1) No member shall resell or permit the resale of water purchased from the Corporation; 2) Contiguous properties with identical ownership shall be deemed to be 1 property; 3) If more than one family unit is located upon the premises then the member shall make an application for each family unit. A separate cut-off valve, meter, and service line shall be installed for each family unit, i.e., a trailer park, duplex, etc. shall have a separate service for each family unit.

Section 5 Extension of Mains

Section 6 Change in Occupancy

Any member requesting termination of service shall give written notice to the Corporation 30 days prior to the time such termination of service is desired. The meter shall be read by the Corporation, upon request, and the member will be billed.

Responsibility for payment for water consumed prior to the date of termination shall be with the property owner as well as the former member. No transfer will be approved by the Board nor will be processed unless the account is paid in full through the date of transfer. Any final not paid within 30 days of transfer date will result in service being discontinued at that site.

There shall be no charge for transferring the water service to the subsequent member other than the applicable membership fees.

Section 7 Payment of Bills

The meter will be read by the Service Technician before the 15th day of each month. If weather conditions or other circumstances prevent the reading of meters, then each water bill will be estimated by the Corporation. The bills will usually be mailed on the last working day of each month and will be due and payable by the 15th. A 10% penalty will be assessed for those customers whose payments are made later than 15 days from the date of mailing. If any bill remains unpaid 30 days after mailing, the water supply to the property affected will be shut off by the Corporation and the service will not be restored until the delinquency and penalty are paid in full. In addition, a $100.00 reconnection fee will be charged for restoration of service. If after 60 days from the date of mailing, the account remains unpaid, all services under the affected member’s name shall be shut off and the membership(s) canceled, and the Corporation may take any legal recourse or remedy available to it under the law to collect the amount due.

Section 8 Tentative Rate Schedule

All members shall pay a $21.00 monthly fee, of which is a monthly assessment and $5.30 per 1000 gallons.
